For the consideration of TRANSGENDER citizens of the Republic of Armenia, who plan to cross the Armenian border

“Right Side” human rights defender NGO works for the protection of the rights and interests of trans people, often receives complaints from trans people, who cannot cross the Armenian border, as a result their right to freedom of movement is violated.
            In front of the organization lays a problem of easing the life of trans people  and do everything in order to fulfil their basic human rights. For that reason, on July 25-th 2017, “Right Side” human rights defender NGO sent a letter to the Border Guard of National Security Service of the Republic of Armenia to get an official response about։
  1. «Can a person cross the border using a passport, in which the photo does not match the person’s appearance?
  2. Is there a special procedure for these people crossing the border, if there is, please specify the procedure?
  3. If the person can’t cross the border with the passport, in which the photo does not match person’s appearance, then how is it regulated the difference between person’s passport photo and appearance?
  4. If the person’s passport is not enough to prove their identity, then what other document can person use to prove their identity, to not get into troubles in the border checkpoint?
           In response to our request on August 7th, 2017 “Right Side” human rights defender NGO got a letter in which it is stated “․․․ At the border checkpoints of the Republic of Armenia, identification of the person, using their photo in the submitted document is the most important process in border control process, therefore, if the person’s photo or sex does not match their appearance, their border crossing is prohibited․․․. It is expedient for the transsexual person to apply to the Police of The Republic of Armenia with changed sex and appearance to get a passport ․․․”.
        Based on the content of the above-mentioned letter, the organization is developing tools and measures, for trans people to cross the border without any problems, to fulfil their right to freedom of movement.
           “Right Side” human rights defender NGO advices to all trans people to follow above-mentioned procedure when crossing the border, and in case of problems apply to “Right Side” human rights defender NGO for legal advice and support. “Right Side” human rights defender NGO will make a new statement about the further developments.
