LEGAL VICTORY: CRIMINAL PROSECUTION OF A TRANSGENDER WOMAN WAS DISCONTINUED ON JUSTIFIED GROUNDS

In 2021, Transgender woman M. applied to the Right Side Human Rights Defender NGO. She reported that on May 27 of the same year, a criminal prosecution was initiated against her under Article 262, Part 2, Paragraphs 5 and 6 of the RA Criminal Code, according to the characteristics of points, that is, contributing to the practice of prostitution, which was done by using two or more persons, as well as a minor, for which a punishment of 3 to 6 years is provided.

From the beginning of the preliminary investigation, the lawyer of the Right Side NGO was involved in the proceedings and defended the interests of the trans woman. During the preliminary investigation, thanks to the competent defense initiated by the lawyer, including the submission of motions and face-to-face interrogations, it became clear that the presented accusation had nothing to do with reality. As a result, after a long struggle, on October 30, 2023, the investigator conducting the proceedings submitted a motion to the prosecutor to stop the criminal prosecution against the transgender woman, on the basis that she did not commit the act she was accused of. The prosecutor accepted the petition and the criminal prosecution was stopped.

As a result, the transgender woman gained the status of vindicated.

The Right Side Human Rights Defender NGO continues to provide free legal assistance to representatives of the Trans LGBIC, sex worker communities, as well as their family members and supporters. Every such victory is of great importance in terms of eliminating the stigma and prejudices surrounding the community, as well as in terms of protecting the rights and ensuring the well-being of the community members.
